Nursery Pollinator Labeling Law In Effect July 1, 2014

The 2014 Minnesota Legislature passed a bill that affects nursery stock labeling and advertising regarding pollinators.  Here is the action paragraph in the bill, which will be added to the "Labeling and Advertising of Nursery Stock" section of Minnesota's Nursery Law and is effective as of July 1st.

MNLA sent a short series of questions to the Minnesota Department of Agriculture (MDA), the agency tasked with enforcing this new law.  Attached are the questions and MDA's answers to those questions that will help your business comply.

MNLA participates in MDA's Nursery and Landscape Regulatory Advisory Committee (MNLRAC), a group that meets periodically to advise MDA's Plant Protection Division (PPD) on issues relating to our industry. At our August 12th MNLRAC meeting, we noted a positive development in the evolving enforcement plan for the new pollinator advertising/ labeling law. PPD Director Geir Friisoe indicated that ALL third-party-produced documents, publications, books, etc. with pollinator-friendly plant information that are distributed or sold by a plant seller will be considered to be "not advertising", as long as they are not produced by or for the plant seller. Geir was also quite emphatic in his statement that ALL plant-seller-produced documents, publications, etc. with pollinator-friendly plant information WILL be considered advertising, with respect to the new law. Nursery inspection supervisor Mark Schreiber added the advice "Sanitize, don't advertise" to ensure compliance.

In response to a specific comment about the Q & A section in the article above, MDA's Geir Friisoe replied as follows: "I do not think that books offered for sale constitute advertising. In looking at our response to #4 I see that we should have been more clear." As MDA begins informing and educating growers and retailers about the implementation of the new nursery advertising/labeling law relating to use of systemic insecticides, there will surely be other updates.
